General Terms and Conditions of Sale - NEORA MOUV'

1. Purpose

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern the contractual relationship between Neoratek , operating the Neora Mouv' brand (hereinafter referred to as "the Seller"), and any individual acting for non-professional purposes (hereinafter referred to as "the Customer"), making a purchase via the website www.neoramouv.com .

Any order placed on the site implies full and complete acceptance of these Terms and Conditions.

3. Products

The products offered for sale are fitness and wellness accessories.

Each product is presented with a detailed description allowing the Customer to know its essential characteristics.
Photographs and visuals are not contractual. Minor variations (colors, textures) may exist depending on the screens or materials used, without affecting the conformity of the product.

4. Price

Prices are shown in euros (€), inclusive of all taxes (TTC) , excluding delivery charges.

The applicable delivery charges are specified before order confirmation.
The Seller reserves the right to change its prices at any time, it being understood however that the price charged will be that in effect at the time of the order.

5. Order

The Customer selects the desired products and confirms their order after verifying the summary.

The Client guarantees the accuracy of the information provided (address, contact details, email).
The order becomes final after payment confirmation.

The Seller reserves the right to cancel or refuse any order in the event of a prior dispute with the Customer or suspicion of fraud.

6. Payment

Payment is due immediately upon ordering.

The accepted payment methods are:

  • Bank card (Visa, Mastercard, etc.)

  • Secure payment solutions offered by Shopify (Shopify Payments, PayPal, or other activated services)

Transactions are secured in accordance with current standards.

7. Availability

Products are offered subject to availability.

In the event of unavailability after order confirmation, the Customer will be informed as soon as possible and may choose between:

  • a full refund

  • or waiting for a restock when possible.

8. Delivery

8.1 Areas served

Deliveries are offered to:

  • Metropolitan France,

  • certain European and international countries depending on the options available on the site.

8.2 Terms and logistics provider

Orders are prepared and shipped by a third-party logistics provider appointed by the Seller.

In accordance with Article L221-15 of the Consumer Code, the Seller remains fully responsible for the proper execution of the delivery , even when it is entrusted to a third party.

8.3 Deadlines

Delivery times are indicated at the time of ordering for informational purposes only.
They may vary depending on the destination and the carrier.

A delivery delay cannot give rise to automatic compensation, except in cases of excessive delay as defined by law.

8.4 Reception

The customer is required to check the condition of the package upon receipt.
Any anomaly (damaged package, missing or non-compliant product) must be reported to the Seller within a reasonable time after receipt, accompanied by supporting documents (photos).

9. Right of withdrawal

9.1 Principle

In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 days from receipt of his order to exercise his right of withdrawal, without justification or penalty.

9.2 Terms and Conditions

The Customer may use the standard withdrawal form provided by law (available on request or on the website).

9.3 Product Returns

The products must be returned:

  • new,

  • not used

  • in their complete original packaging.

Return shipping costs are the responsibility of the customer.

9.4 Reimbursement

The refund will be issued within a maximum of 14 days from receipt and inspection of the returned products, via the same payment method used for the order.

9.5 Exceptions

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for products used or unsealed for hygiene reasons, when they cannot be returned for health protection reasons.

10. Legal Guarantees

The products benefit from:

  • of the legal guarantee of conformity (articles L217-3 to L217-20 of the Consumer Code),

  • of the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

These guarantees apply independently of any commercial warranty.

11. Responsibility

Neora Mouv' products are intended for personal and non-medical use.

The Seller cannot be held liable for damages resulting from:

  • from improper or unsuitable use,

  • due to failure to comply with the instructions for use,

  • indirect damages (loss of opportunity, loss of profit).

12. Intellectual Property

All elements of the site (texts, images, logos, visuals, packaging, videos, graphic charter) are protected by intellectual property law.

Any reproduction or use without prior written authorization is strictly prohibited.

13. Personal data

Personal data is processed in accordance with the GDPR.
They are used exclusively for managing orders, deliveries, payments and customer relations.

15. Consumer mediation

16. Disputes and Jurisdiction

In the event of a dispute, an amicable solution will be sought as a priority.

Alternatively, the Client may enter:

  • either the court of his place of residence,

  • either the court of the place where the Seller's registered office is located,

in accordance with applicable legal provisions.

17. Applicable Law

These terms and conditions are governed by French law .
